Two men who attacked police offers in a mob now risk facing two years imprisonment at their own plea of guilty.
This
comes after the court adjourned their case in order to rectify proper
charges against the culprits who affirmed to throwing stones at the
officers.
Fredrick Njoroge,31 and John Mwangi 28 will remain in custody until
the court can correct two of all three counts they accepted.
They were charged before Resident Magistrate Esther Nyongesa for committing the offences at Kahawa Sukari on 9th October.
First the touts resisted arrest and threatened the officers saying "
mumezoea kutushikashika leo mutatuona....". They further incited
violence in a mob while throwing stones directed at the officers
station. They continued to damage a motor vehicle through the tag of war
and activity.
According to law the first two charges carry lenient fines such as
sh 20,000 which was not appropriate on record. The two committed a crime
of obstructing officers while on line of duty.
Therefore,the
Prosecutor begged the court to correct the first two charges in line
with with the New police National service act of 2011 as recently passed
by the Parliament.
In the new service act the fine holds up to sh 500,000 or default two years imprisonment.
