A 49 year old man risks facing atleast 20 years
imprisonment, accused of repeatedly facilitating abortions in Kayole.
The man was arrested after two foetus were found dumped in a
hidden room at Glory Medical Centre last Friday.
Another baby was also found alive but placed in a bucket
under one of the beds, estimated to be 1-4 days old.
Julius Kimotho Wambui
was charged jointly with others not before a Makadara court.
He denied two counts
of killing an unborn child, contrary to section 228 of the penal code.
Administration Officers at Kayole's District Commissioners
office set a trap on the fateful day to ambush the premises and make arrests.
The officers prompted one of their female colleagues, an
expectant mother to approach the clinic
and negotiate for abortion.
Kimotho allegedley encouraged the officer to instantly
proceed with the process at a sh 5000 charge for the operation on 10th January.
When the officer was escorted to the room to begin the
operation she called her colleagues to inspect the medical centre.
One foetus was a male child and the other of unknown gender.
They were rushed to city mortuary. While the live baby was escorted to Mama
Lucy hospital and admitted at ICU.
Shortly after denying the charge, Julius told the court he
failed to understand the reasons for his arrest and was unaware of the
situation. Atleast five witnesses have
been listed to testify in the case.
Prosecutor Leonard Kurgat said the offense carries a minimum
sentence of 20 years imprisonment.
Senior Principal Magistrate Timothy Okello granted a sh
200,000 cash bail.
The case will be heared on May 8th this year.
