A 33 year old man accused of murdering his neighbor had his case reduced to manslaughter charges yesterday.
Simon Mbuthia told a Makadara court the death was an accident during a fight in self defense.
He allegedley killed Joseph Macharia on December 2nd on his way home from work at Githurai Estate.
Yesterday
he stood at the dock clothes soiled and stained with blood. He was
saved by police from mob justice formed by angry residents.
Mbuthia stated that 3 men cornered him near their home plot
including the deceased with intentions to steal sh 2000 from his
pockets.
The father of two children told the court "Your honour we were drunkards and fighting heavily." Mbuthia said.
Consequently Mbuthia fought back and used a piece of wood to
attack. Unfortunately he hit the deceased on the back of his head and
dropped instantly to the ground.
Angry residents realised the incident and attacked Mbuthia. He was put to safety in Kimbo police station.
In a letter from office of DPP dated 4th December it stated that
investigations were clear that both deceased and Mbuthia fought under
the influence of alcohol.
The Makadara court was asked to reduce
the Charge following clear perusal of evidence further sighting the two
were fighting over sh 50.
Mbuthia was granted a cash bail of sh 100,000 . The case will be heared on March 7th next year.
